Terms of Service — Captain Jack Tours

These Terms of Service (“Terms”) govern your use of our website, booking platform, and tour services. By making a booking, paying a deposit, or participating in a Captain Jack Tours experience, you agree to these Terms.

 

1. Bookings & Payments

A non-refundable deposit is required to secure your booking. The deposit amount will be stated in your confirmation email or invoice (commonly $20–$100 USD per person depending on the tour).
The remaining balance is due prior to the start of your excursion, payable in cash (USD or XCD) or by credit/debit card via our secure payment link.
Prices are quoted in USD unless otherwise stated.
Your booking is only confirmed once the deposit has been successfully received

 

2. Partner-Operated Tours

Some experiences offered by Captain Jack Tours are operated by independent third-party providers (“Partner Tours”). These experiences are clearly identified on our website and/or in booking communications as Partner Tours.

When you book a Partner Tour, Captain Jack Tours acts as the booking coordinator and guest liaison. The third-party operator is responsible for the execution of the tour, including transportation, equipment, staffing, safety procedures, and on-site operations.

Captain Jack Tours remains your primary point of contact for booking communication, coordination, and guest support before, during, and after the experience. By booking a Partner Tour, you acknowledge and agree that the experience may be fulfilled by a third-party operator under this arrangement.

 

3. Transportation & Pickup

Pickup times are estimates and may vary due to traffic conditions, weather, cruise ship clearance, security procedures, or access restrictions at resorts, ports, or private properties. Minor delays do not constitute grounds for refund.

Guests are responsible for being ready at the confirmed pickup location at the scheduled time. Failure to arrive on time or be present at the designated location may be treated as a no-show, and all payments may be forfeited.

 

4. Cancellations & Changes

Guest Cancellations:

Deposits are non-refundable except in the event of a full cancellation by Captain Jack Tours (see below).
Cancellations made at least 72 hours in advance are eligible for deposit credit toward a future booking (valid for 12 months).
Cancellations within 48 hours of the scheduled start are non-refundable and not eligible for credit

Changes to Date or Time:

Changes are subject to availability and must be requested at least 48 hours before the scheduled tour.

Captain Jack Tours Cancellations (Weather or Safety):

If we cancel due to unsafe weather, mechanical issues, or other safety concerns, you may choose to:

Reschedule to a new available date, or
Receive a full refund of amounts paid.

No-Shows:

Guests who fail to arrive at the designated meeting point by the scheduled time may forfeit all payments.

 

5. Minimum Participation

Some tours require a minimum number of participants to operate. If minimum participation is not met, Captain Jack Tours may offer a reschedule, an alternative experience, or a refund of amounts paid.

 

6. Participant Responsibilities

Arrive on time at the meeting point stated in your confirmation email or WhatsApp message.
Follow all instructions from your captain, driver, guide, or tour staff.
Disclose any medical conditions, physical limitations, or mobility concerns prior to participation.
Refrain from behavior that endangers yourself, others, wildlife, or property.

 

7. Wildlife & Animal Encounters

Some tours involve interaction with wildlife or animals in their natural or managed environments. Animal behavior can be unpredictable.

By participating, guests agree to follow all instructions provided by guides and acknowledge that participation is at their own risk. Captain Jack Tours and its partners are not responsible for injuries or incidents resulting from failure to follow safety guidance or animal interaction protocols.

 

8. Assumption of Risk

Our tours may include water activities, boating, animal encounters, off-road driving, hiking, and other outdoor experiences that carry inherent risks. By booking, you acknowledge and accept these risks and agree to participate at your own responsibility.

 

9. Liability

To the fullest extent permitted by law:

Captain Jack Tours is not liable for personal injury, illness, loss, or damage to personal belongings during your experience, including experiences operated by third-party partner providers.
Our total liability will not exceed the amount paid for the affected service.

 

10. Personal Property

Captain Jack Tours is not responsible for lost, stolen, or damaged personal items, including phones, cameras, wallets, or other valuables. Waterproof bags are recommended for water-based excursions.

 

11. Intellectual Property

All website content, tour descriptions, images, branding, and marketing materials are owned by Captain Jack Tours or used with permission. Reuse or reproduction without written consent is prohibited.

13. Force Majeure

Captain Jack Tours is not responsible for cancellations, delays, or changes caused by events beyond our reasonable control, including but not limited to hurricanes, severe weather, natural disasters, government restrictions, port closures, strikes, or other acts of God.

 

14. Governing Law

These Terms are governed by the laws of Antigua & Barbuda and, where applicable, U.S. law for transactions processed through U.S.-based payment systems.
